1. Acceptance of Terms

By accessing and using FetchKomi ("Service", "we", "us", or "our"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use our Service.

2. Content Ownership and User Responsibilities

2.1 User Warranty

You explicitly warrant and represent that:

  • You own the copyright to any content you download through our Service, OR
  • You have explicit written permission from the copyright holder to download and use such content, OR
  • The content is in the public domain or licensed under terms that permit downloading

2.2 Prohibited Uses

You agree NOT to use downloaded content for:

  • Commercial redistribution: Selling, licensing, or redistributing content you do not own
  • Public distribution: Sharing content on platforms, websites, or services where you do not have rights
  • Commercial purposes: Using downloaded content for advertising, promotional, or commercial activities without proper authorization
  • Copyright infringement: Any use that violates intellectual property rights

2.3 Full Liability Acceptance

YOU ACCEPT FULL AND EXCLUSIVE LIABILITY FOR ANY COPYRIGHT VIOLATIONS

By using this Service, you acknowledge that you are solely responsible for ensuring your use of downloaded content complies with all applicable copyright laws and regulations. You agree to indemnify and hold harmless FetchKomi, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your copyright violations.

3. Service Liability and Disclaimers

3.1 No Responsibility for User Violations

FetchKomi is a technology service provider that offers tools for downloading publicly accessible content. We are NOT responsible for:

  • How users choose to use downloaded content
  • Copyright violations committed by users
  • Legal consequences arising from user misconduct
  • Verification of user ownership or permission for downloaded content
  • The legality of content downloaded through our Service

3.2 DMCA Compliance

FetchKomi respects intellectual property rights and will comply with all valid Digital Millennium Copyright Act (DMCA) notices. If you believe content downloaded through our Service infringes your copyright, please contact us immediately with:

  • Identification of the copyrighted work
  • Description of the infringing material
  • Your contact information
  • A statement of good faith belief that the use is unauthorized
  • A statement that the information is accurate and you are authorized to act on behalf of the copyright owner

3.3 Account Termination for Violations

Immediate account termination: We reserve the right to immediately terminate or suspend your account, without prior notice or refund, if we receive valid DMCA notices, evidence of copyright violations, or any breach of these Terms of Service. Repeated violations may result in permanent ban from our Service.

4. Pro Plan Service Terms

4.1 Pro Plan Description

The FetchKomi Pro plan is a premium subscription service that provides users with enhanced features, including:

  • 100 GB of dedicated cloud storage for content and media uploaded by you
  • Unlimited downloads from supported platforms
  • Ad-free experience
  • Playlist download support
  • Bot integrations for Discord and Telegram
  • Priority customer support

4.2 Storage Usage and Limitations

Storage Guarantee: Pro plan subscribers are guaranteed exactly 100 GB of cloud storage space for their personal content. This storage is for:

  • Videos and media downloaded through our Service
  • Content uploaded by the user to their personal library
  • Associated metadata and thumbnails

Users are responsible for managing their storage capacity. If you exceed the 100 GB limit, you may not be able to upload or download additional content until you free up space.

4.3 Plan Types and Access Duration

FetchKomi offers the following Pro plan options:

30 Days

Access to all Pro features for 30 days from purchase date

180 Days

Access to all Pro features for 180 days from purchase date

Lifetime

Permanent access to all Pro features with no expiration

4.4 Plan Expiration and Storage Access

After Pro plan deactivation or expiration:

  • You will NOT be able to upload new media to your cloud storage
  • You will NOT be able to download new videos to your storage
  • Your existing stored content will remain accessible for download for a grace period of 30 days
  • After the 30-day grace period, your content may be archived or deleted
  • Unlimited downloads and other Pro features will be restricted to free tier limitations

We recommend downloading your stored content before your plan expires if you do not intend to renew.

4.5 Payments and Refunds

All Pro plan purchases are processed through our secure payment provider. Due to the digital nature of our Service and immediate access to premium features, all sales are final and non-refundable, except as required by law. This includes but is not limited to:

  • 30-day access purchases
  • 180-day access purchases
  • Lifetime license purchases

We encourage users to try our free tier before purchasing a Pro plan to ensure our Service meets your needs.

5. Service Modifications and Availability

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including the availability of features, databases, or content. We may also impose limits on certain features or restrict access to parts of the Service without notice or liability.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FETCHKOMI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code that may be transmitted through the Service
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted or shared through the Service

7. Indemnification

You agree to indemnify, defend, and hold harmless FetchKomi, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the Service, including but not limited to any copyright infringement claims.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which FetchKomi operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
